The Privacy and Electronic Communications (Amendment) (No.2) Regulations 2018/1396 in force on 9 January 2019.  


Final regulations have been issued intended to prohibit cold calling in relation to pensions, following a response to consultation issued in October 2018.

Cold calling in relation to pensions will be banned except where one of the following applies.

The Information Commissioner's Office (ICO) may use its powers to issue civil fines up to £500,000 for breach of the Privacy and Electronic Communications (EC Directive) Regulations 2003 (which will be amended to include the ban on cold calling in relation to pensions). The ICO is expected to publish guidance when the ban comes into force.
